These Terms of Service (“Terms”) govern your access to and use of the ProFormance Peptides website, any related services, and your purchase of products through it. By accessing this website or placing an order, you agree to these Terms. If you do not agree, do not use this website.

1. Eligibility & age requirement

You must be at least 18 years of age and legally able to enter into a binding contract to use this website or place an order. By purchasing, you represent and warrant that you meet these requirements and that all information you submit to us is true, accurate, and complete.

2. Research use only — not for human or animal use

All products are sold strictly for laboratory and research purposes and are not drugs, foods, cosmetics, or supplements. Products are not intended for human or veterinary use, consumption, ingestion, injection, or administration of any kind, and have not been evaluated or approved by the U.S. Food and Drug Administration. Nothing on this website is medical, pharmaceutical, or professional advice, and no product is intended to diagnose, treat, cure, or prevent any disease. By purchasing any product, you acknowledge and agree that the product will be used only in a lawful research setting by qualified persons with appropriate training and safety protocols.

3. Buyer responsibility & lawful use

You are solely responsible for determining the suitability, legality, handling, storage, use, and disposal of any product you purchase, and for complying with all applicable federal, state, and local laws and regulations. You represent that you are a qualified researcher (or are acquiring products on behalf of one) with the training and facilities to handle research materials safely and lawfully. You will not resell or use any product in violation of law or for any human or animal use. You are solely responsible for obtaining any approvals, permits, licenses, or other authorizations required for your purchase, receipt, possession, use, or transfer of any product.

4. Orders, pricing & payment

All orders are subject to acceptance and product availability. Prices are shown in U.S. dollars and may change without notice. Payment is made through manual methods (ACH, Zelle, Venmo) as described at checkout; no payment is processed automatically and orders are confirmed only after payment is received and verified. We may refuse or cancel any order at our discretion, including where we suspect unlawful use or where required by a payment provider’s policies. If we cancel an order after receiving payment, our sole obligation will be to refund the amount actually received for that order, unless the cancellation results from suspected fraud, chargeback risk, unlawful activity, or a violation of these Terms.

5. Shipping

We currently ship within the United States only. Title and risk of loss pass to you upon our delivery of the shipment to the carrier. Estimated delivery times are not guaranteed. You are responsible for providing a complete and accurate shipping address, and we are not liable for delay, loss, or non-delivery resulting from incorrect address information, carrier issues, weather, force majeure events, or other causes beyond our reasonable control.

6. Returns

Sales are final and products are non-returnable except as set out in our Refund & Returns Policy, which is incorporated into these Terms by reference.

7. No warranties

To the fullest extent permitted by law, all products and this website are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in writing by us. No oral or written information, statement, or advice provided by us will create any warranty unless expressly set out in a written agreement signed by us.

8. Limitation of liability

To the fullest extent permitted by law, ProFormance Peptides and its owners and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any improper, unauthorized, or unlawful use of products. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. The limitations in these Terms apply regardless of the form of action, whether in contract, tort, strict liability, statute, or otherwise, and even if we were advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless ProFormance Peptides and its owners, employees, and affiliates from any claims, damages, liabilities, and expenses arising out of your use or misuse of products, your violation of these Terms, or your violation of any law or the rights of any third party. This includes reasonable attorneys’ fees and costs of investigation, defense, and settlement.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Broward County, Florida. You consent to the exclusive jurisdiction and venue of those courts and waive any objection based on inconvenient forum or improper venue.

11. Changes

We may update these Terms from time to time. Continued use of the website after changes take effect constitutes acceptance of the updated Terms. The “Effective date” above will indicate when the latest version became effective.

13. Prohibited conduct

You may not use this website or any product to violate any law, infringe any person’s rights, misrepresent your identity or intended use, interfere with the operation or security of the website, attempt unauthorized access to any system or data, or engage in any activity that could expose us or our service providers to legal or regulatory risk.

14. Intellectual property

All content on this website, including text, graphics, logos, images, product descriptions, and website design, is owned by or licensed to ProFormance Peptides and is protected by applicable intellectual property laws. 16. Severability; waiver; entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not operate as a waiver of that provision or any other provision. These Terms, together with any policies expressly incorporated by reference, constitute the entire agreement between you and ProFormance Peptides regarding the website and product purchases and supersede all prior or contemporaneous understandings relating to them.
